Anaheim bans the opening of any NEW short-term rental. Under Anaheim Municipal Code (AMC) Chapter 4.05 ("Short-Term Rentals Ordinance") — added by Ord. 6299 (May 13, 2014) and comprehensively amended by Ord. 6374 (the "STR Regulations and Ban on New STRs Ordinance," adopted July 12, 2016, operative Aug 11, 2016) — a short-term rental (rental of a dwelling, or portion, for less than 30 consecutive days) is "no longer" an allowable use in any Single-Family Residential Zone (AMC 18.04.020), Multiple-Family Residential Zone (AMC 18.06.020), or any other zone in which residential use is a permitted or conditionally permitted use (AMC 4.05.020, 4.05.040.030). A city moratorium on new STRs was first adopted Sept 15, 2015 (Ord. 6343). Only "pre-moratorium short-term rentals" (owners authorized to operate before Aug 11, 2016, or whose pending application was filed before Sept 16, 2015) may continue, by renewing an existing Short-Term Rental Permit annually and holding a business license (Ch. 3.04) plus collecting the 15% Transient Occupancy Tax (Ch. 2.12). The 2016 ban originally imposed an 18-month amortization terminating pre-moratorium STRs after Feb 11, 2018, but Ord. 6466 (adopted June 18, 2019) amended AMC 4.05.180 so that "Qualifying Pre-Moratorium Short-Term Rentals," "Pre-Moratorium Home Share Short-Term Rentals," and "CC&R Restricted Short-Term Rentals" (each defined by status as of June 1, 2019 with a valid permit + timely hardship-extension application) are NOT subject to that amortization/termination and may continue with annual renewal (AMC 4.05.180.0101). "CC&R Restricted Short-Term Rentals" (those in an HOA whose CC&Rs prohibit STRs) were separately prohibited in residential zones after Dec 31, 2022, with a one-time option to convey the permit to a non-CC&R-restricted property (AMC 4.05.180.0102). Net effect for a prospective new host: new STR permits are not issued and STRs are effectively prohibited citywide except for the fixed legacy set (and except STRs in the C-G General Commercial Zone authorized by a conditional use permit approved before the Sept 15, 2015 moratorium, which may still obtain new permits — AMC 4.05.040.030). Key operating limits for permitted STRs: 3-night minimum stay; occupancy capped by bedroom count (studio 2 → 8+ bedrooms 19); minimum 2 off-street parking spaces; city-issued permit number (REG ID#) required in all advertising; quiet time 10 p.m.–9 a.m.; permit expires each July 31 and is personal to the owner (does not run with the land). Dwellings with more than 8 bedrooms are capped at 19 occupants. If the permit sets a lower limit, that lower limit governs.
