Nags Head
Nags Head is one of the most permissive STR regimes on the North Carolina Outer Banks: short-term rentals (rentals of fewer than 30 days) are allowed as of right in EVERY zoning district, with no primary-residence requirement, no cap on the number of rentals, no annual night cap, and no minimum-stay floor. The Town Code (zoning ordinance codified as Chapter 48 of the Town Code) recognizes two STR types defined by the Town: "short-term rental, whole house" (entire single-family dwelling rented to one housekeeping unit for fewer than 30 days) and "short-term rental, partial house" (a resident-occupied single-family dwelling renting up to two guest rooms for fewer than 30 days, subordinate and incidental to the principal residential use). The Board of Commissioners adopted the STR registration ordinance in April 2019 (Town news item posted 2019-04-17); first-year registration was not required until 2019-12-31, and thereafter registration must be renewed ANNUALLY prior to September 1st. The permit instrument is a Short-Term Rental Registration filed with the Town's Planning & Development Department, fee $25 per short-term rental. Critically, registration is NOT universal: rentals "managed by a real estate broker as defined in G.S. 93A-2(a)" are EXEMPT, as are hotels/motels/tourist camps regulated under NC G.S. Chapter 72, rentals to persons having no other place of primary residence, and rentals for nominal consideration. Because most Outer Banks vacation homes are broker-managed, the registration program in practice targets owner-managed Airbnb/VRBO operations. Key operating limits: partial-house STRs are capped at a maximum of two bedrooms (renting more may constitute a bed and breakfast, requiring a conditional use permit depending on zoning) and must supply one additional off-street parking space beyond the single-family minimum; whole-house STRs need no additional parking. Liability insurance must be DISCLOSED but is not required. Operators must comply with the NC Vacation Rental Act (G.S. Chapter 42A) including its minimum safety provisions. Taxes: Dare County levies a 6% occupancy tax on gross receipts (county-administered, due the 20th of the following month; not applicable to a private residence/cottage rented fewer than 15 days per calendar year, or to stays of 90+ continuous days), plus NC state and local sales & use tax totaling 6.75% in Dare County (4.75% State + 2.00% local, effective 2026-07-01). Because Dare County is listed under the uniform room occupancy tax provisions of G.S. 153A-155, an accommodation facilitator (Airbnb/Vrbo) carries the same occupancy-tax responsibility and liability it has under the State sales tax on accommodations. Enforcement is penalty-backed: $100 civil penalty for failure to register within 30 days of offering, then $50 per day, and the operator "may not continue to offer such property for short-term residential rental" until the penalty is paid and the property registered. Zoning: Short-term rentals are allowed in every zoning district. The Town's zoning ordinance is codified as Chapter 48 of the Town Code. Only the partial-house type carries a resident-occupancy condition; whole-house STRs have no residency condition. Escalating beyond two rented guest rooms shifts the use into bed-and-breakfast territory, which is zoning-dependent and conditional-use-permit gated.
