Folly Beach regulates short-term rentals (any rental under 30 days) under Folly Beach Code of Ordinances Chapter 117 (Short Term Rentals), §§ 117.01-117.04. The cap is currently full — the city states "No new licenses are projected to be available for the next business license year" — and a phased waitlist is maintained under § 117.02(C)(3). Existing ISTR licenses in good standing may still renew even above the cap, but all license types terminate on transfer of property and are non-transferable (§ 117.02(D)), so a buyer of an ISTR property generally cannot inherit the seller's license; narrow exceptions exist for inheritance from the owner of record on 2-7-2023 and for medical hardship. ISTR licenses must be rented a minimum of 28 nights/year to stay in good standing; OSTR licenses may not exceed 72 nights/year. Minimum stay is 2 consecutive nights in any zoning district. Maximum overnight occupancy is 2 persons per bedroom plus 2 per dwelling unit, and one on-site parking space per rented bedroom is required. Grandfathering: Yes, multiple grandfathering mechanisms: (1) any ISTR license in good standing may continue to renew annually even if the total number of ISTR licenses exceeds the cap; (2) the portion of a dwelling unit taxed at a 6% property tax rate that was licensed as an STR prior to February 7, 2023 may renew an existing ISTR and is not subject to the 72-night OSTR limit; (3) units holding a valid business license and rental registration permit before September 13, 2022 may renew without meeting the one-space-per-bedroom parking requirement until ownership changes; (4) an ISTR may be newly issued for a unit inherited after February 7, 2023 from the person named as owner of record on February 7, 2023 (application within 90 days of transfer).
